Proposition 19 


MediCann, as a patient advocate, is committed to educating the patient community without bias. As a compassionate group of Doctors dedicated to our patients' welfare and right to choose their own best medicine, we advocate for the sensible rescheduling of cannabis at the Federal level. To MediCann and our patients, Medical Cannabis is our best medicine. The Tax Cannabis initiative facing California residents in November aims to legalize Cannabis for recreational purposes. The law would leave the Taxation and Regulation of Cannabis to individual localities at the city and county levels.

Patients need to understand the benefits and risks making informed decisions when deciding what’s right for them. Though an initiative for recreational usage this bill certainly will impact the Medical Marijuana community and California residents Statewide.

The truth(s) about Prop 19:
• For the first time in the history of California we have an initiative in Proposition 19 that allows fundamental changes to the law if approved by VOTERS in November at the legislative level. No other amendment allows for such changes and prior to the late 40’s the California Legislative body was prohibited from even introducing bill(s) that amended VOTER approved initiatives. What this means to Californians, IF Tax Cannabis passes, is that lawmakers may decide that the initiative needs to be changed. Legislators could and would without voter approval and a 2/3’s majority, alter the Tax Cannabis legislation as deemed necessary. These changes could include the outright ban of the substance. 

• Tax Cannabis limits personal possession to one ounce and cultivation to a five-by-five plot, or 25 square feet. This is guaranteed to keep law enforcement employed, raiding and prosecuting people for marijuana.

• Tax Cannabis explicitly criminalizes the commercial sale, production, and cultivation of marijuana in cities and in counties that do not tax and regulate marijuana "without limitation."

• Tax Cannabis "sends the wrong message" by placing the age limit the same as alcohol, even though marijuana is much safer.

• Tax Cannabis would make public consumption illegal, creates new felonies where there were none before, and makes it illegal for parents to smoke in front of their own kids.

• Tax Cannabis will limit competition and create monopolies by preventing ordinary people from getting into the business.

We support our Patients that choose to vote in November and those who do not equally, though we believe the preponderance of Patients, once educated, will choose their right to grow, medicate or posses as outlined under current California law Proposition 215.
